**Los Angeles County Jail Notarizations**

### Important Information Before Scheduling a Jail Notarization:

1. **Each Facility Has Different Procedures**: Each jail has its own rules based on its location, staff, and security level.

  • a. You should always contact the jail prior to contacting a Notary Public to ensure they allow visitors.

    ​b. You should contact the inmate prior to the Notary's visit to the jail to ensure you have gone over why you are sending a Notary to them and what type of document they will be signing. Notaries are not responsible for going over documents with inmates. Notaries are not attorneys and cannot offer legal advice.

2. **Expect Long Wait Times**: Delays can happen because of facility lockdowns, staff shortages, or limits on visitations, which I cannot control. Wait times can be 30 minutes to 3 hours.

3. **Proper ID Is Required**: The inmate must have a jail wristband or a state-issued ID that matches the name on the document exactly. If there is any mismatch, I must decline the notarization by law.

4. **No Guarantees of Access**: Sometimes, we may not be able to complete the visit despite best efforts. This can occur at the facility's full discretion. This is beyond our control.

5. **Mobile Fees**: Please note that I will charge fees for my time, travel, and any attempted notarization, regardless of whether the signing is successful. Fees will apply if the inmate declines to sign or if the facility is unable to provide the inmate for any reason.

California law requires that the signer must be mentally aware, understand the nature of the document, and sign willingly. If the signer is under sedation , disoriented or lacks capacity at the time of notarization, I am legally prohibited from proceeding.

  • Visits cannot always be guaranteed. There are times, despite the efforts of everyone involved, when a visit may not take place due to reasons determined by the correctional facility. These factors are beyond my control.

    "Please note that all jail notarizations include a mobile service fee, regardless of whether the signing is completed. This covers travel, security check-in, coordination, and professional time on-site. If the inmate is unavailable, declines to sign, or the jail denies access, the notarization cannot proceed, but the travel and time fees will still apply.

What you should know

  • Before Scheduling your Notary Appointment:

    Review your documents for any errors or incomplete sections of the documents. If you have found any errors or incomplete sections contact your attorney or agency for correction. Give us a call to schedule your appointment. when your documents have been complete and or corrected. Catching any errors beforehand will prevent notarization delays.

    What you need to bring to your Notary appointment:

    1. Valid Government-Issued Photo ID (Non-Expired)

    • California Notaries are required by State law to verify your identity before notarizing your document.

    Acceptable forms of ID include:

    • Current Driver's License

    • Valid Passport

    • Current State issued photo ID card

    Note:

    Ø  Your photo ID must be current - Not Expired

    Ø  The name on your photo ID must match the name that is written on the documents that need to be signed and notarized.

    2. Original Unsigned Documents:

    Bring the original document to your Notary appointment. DO NOT sign your document before your Notary appointment. You are required to sign the document in the notary's presence.

    3. Multiple Signers:

    If your document requires multiple signers, each person must be present with their own valid photo un-expired ID. Confirm that each signer will be available before scheduling your Notary appointment. All signers need to be present for the notarization.

    During Your Notarization:
    The Notary
    will verify your identity before your documents get notarized. This is a must according to State of California Law to protect and prevent fraud.

    The Notary will carefully review your photo ID, verifying that the name on the ID and the name on the documents match.

    Review of your Documents:

    The Notary will review your documents to ensure that they are complete and ready to be signed and notarized. We check for blank spaces, missing information, name mismatch or other inconsistencies that would cause non-acceptance of your document.

    Oath or Affirmation:

    Certain documents, such as affidavits and sworn statements, require a verbal oath or affirmation under California State law. This process is simple and straightforward.

    Notarization:

    Once your documents have been verified and are ready to be signed, you'll sign the document in the Notary’s presence. The Notary will then notarize the document with the official State of California Notary seal and Notary signature, ensuring your document is complete and within legal compliance. You will then sign and place your right thumb print for the Notary journal. This entry is for all the documents that were signed and notarized. Notary Journal Entry is a State of California Law Requirement.

    Appointment Duration: (approximately)

    Standard one document notarizations: 10-15 minutes

    Multiple documents or Signers: 20-30 minutes

    Loan Documents and Estate planning packages: 30-60 minutes

    (Adequate time is always given to ensure your notarization process is not rushed & goes smoothly)

    The Notary is Not an Attorney

    California law prohibits Notaries from providing legal advice or interpreting document contents. If you have questions about your document, please consult with your attorney or the agency of your documents before your notarization appointment.

  • If the signer is not alert or coherent, the notarization cannot be performed. California law requires that the signer must be mentally aware, understand the nature of the document, and sign willingly. If the signer is under sedation, disoriented, or lacks capacity at the time of notarization, I am legally prohibited from proceeding. You can reschedule the notarization at a better time.

    • Have the document ready. It must be complete (except for the signature) and ready for notarization.

    • Be prepared for delays or rescheduling. I do my part professionally and promptly, but I respect the jail’s policies and procedures at all times.

    As a commissioned Notary Public in the State of California, I perform all notarizations in strict compliance with California Government law and under the guidance of the California Secretary of State.

  • By scheduling a notarization with Linda D. Rico, Notary Public with Buenavista Legal Signings LLC., you acknowledge and agree to the following:

    1. Linda D. Rico is not an attorney and cannot provide legal advice.
      California law prohibits Notaries from assisting in the preparation of legal documents, answering legal questions, or providing guidance on the content or legality of any document.

    2. All documents must be fully completed prior to notarization.
      Blank spaces or incomplete sections will result in a declined notarization in accordance with California law.

    3. Valid identification is required.
      The signer must present an approved, unexpired photo ID pursuant to California Civil Code §1185. If proper ID is not available or acceptable, the notarization will be declined.

    4. The signer must be willing, aware, and present.
      I will not proceed with a notarization if I believe the signer lacks mental capacity, is under duress, or is otherwise unable to communicate clearly.

    5. Name on ID must match the name on the document.
      Especially in jail notarizations, all names must match exactly to proceed. If they do not, the notarization will be declined.

    🚫 Limitations & Cancellations

    • Notarization is not guaranteed.
      If access to a facility is denied, the signer is unavailable, unwilling, not coherent, or does not have proper ID, the notarization cannot be completed. Standard mobile and wait-time fees still apply.

    • Fees are due regardless of outcome.
      You agree to compensate the notary for all time, travel, and professional efforts, even if the signing is unsuccessful due to factors outside of the notary’s control (e.g., facility lockdowns, ID issues, signer refusal, Not capable).

    • No liability for content or consequences of documents.
      The notary is not responsible for the validity, accuracy, or enforceability of any document being notarized.

    By using my services, you confirm that you understand and agree to this disclosure and that you are not relying on the notary for legal advice or document review.
